Modern Village LLC ("Modern Village," "we," "us," or "our") is committed to protecting the privacy and security of your personal information and your children's information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform at modernvillage.app.

1. HIPAA Privacy

Modern Village may collect, store, and process Protected Health Information ("PHI") as defined under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"). When we act as a Business Associate to healthcare providers on our platform, we comply with the HIPAA Privacy Rule, Security Rule, and Breach Notification Rule.

PHI collected through Provider sessions is governed by the applicable Provider's Notice of Privacy Practices and our Business Associate Agreement. We do not use PHI from Provider sessions for marketing purposes or sell PHI to third parties.

2.2 Information Collected Automatically

When you use the Platform, we may automatically collect device information (browser type, operating system), usage data (pages visited, features used, session duration), and IP address. We use this information to maintain security, improve the Platform, and comply with legal obligations.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Platform and its features
  • Personalize AI Coach responses based on your child's profile
  • Facilitate connections between Users and Providers
  • Send transactional communications (booking confirmations, reminders, cancellations)
  • Monitor and enforce community guidelines
  • Detect and prevent fraud, abuse, and security incidents
  • Comply with legal obligations, including HIPAA requirements
  • Generate aggregate, de-identified analytics for district partners (never individual-level data)
  • Respond to your requests and provide customer support

4. How We Share Your Information

We do not sell your personal information or your children's information to third parties. We may share information with:

  • Providers: When you book a session, your child's profile information is shared with the Provider to facilitate the session
  • Service Providers: We use third-party services to operate the Platform, including Supabase (database), Cloudflare (API infrastructure), Resend (email), Stripe (payments), Doxy.me (telehealth video), and Anthropic (AI processing). Each service provider receives only the minimum information necessary to provide their service.
  • District Partners: If your school district has a partnership with Modern Village, we may share aggregate, de-identified usage data with the district. We never share individual child data with districts without your explicit consent.
  • Legal Requirements: We may disclose information when required by law, subpoena, court order, or to protect the rights, property, or safety of Modern Village, our users, or others.

5. Data Security

We implement administrative, technical, and physical safeguards to protect your information, including:

  • Encryption in transit (TLS/HTTPS on all connections)
  • Encryption at rest (AES-256 via Supabase Pro)
  • Row-Level Security policies ensuring users can only access their own data
  • JWT authentication on all API endpoints
  • Rate limiting to prevent abuse
  • Audit logging of all PHI access
  • 30-minute session timeout for idle sessions
  • Regular security assessments

No method of electronic transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

6. AI Coach & Data Processing

When you use the AI Coach, your messages and your child's profile information are sent to Anthropic's Claude API to generate responses. We use Anthropic's API with zero data retention settings, meaning Anthropic does not store or use your data to train their models. AI conversations are stored in our database to maintain your conversation history and improve service quality.

7. Children's Privacy

Modern Village is designed for use by parents and caregivers of children — not by children directly. We do not knowingly collect personal information from children under 13 without parental consent. All child information is provided by the parent or guardian through the child profile feature.

If you believe a child has provided personal information directly to us without parental consent, please contact us immediately at hello@modernvillage.app and we will delete the information.

8. Data Retention

We retain your information for as long as your account is active or as needed to provide services. After account deletion, we will delete or de-identify your personal information within 90 days, except where retention is required by law (e.g., HIPAA requires retention of certain records for 6 years).

9. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate personal information
  • Deletion: Request deletion of your personal information (subject to legal retention requirements)
  • Data Portability: Request a copy of your data in a portable format
  • Opt-Out: Opt out of non-essential communications

10. California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

  • The right to know what personal information we collect and how it is used
  • The right to delete your personal information
  • The right to opt out of the "sale" of personal information (we do not sell personal information)
  • The right to non-discrimination for exercising your privacy rights

11. Cookies & Tracking

The Platform uses essential cookies and local storage for authentication and session management. We do not use third-party advertising cookies or cross-site tracking technologies. We do not participate in ad networks or sell data to advertisers.

12. Third-Party Links

The Platform may contain links to third-party websites or services (e.g., in our Resource Directory). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing personal information.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the revised policy.
